Coastal Baby Rentals Equipment Care Guidelines, Policies, Liability Waiver Terms & Conditions

PLEASE READ FOR YOUR SAFETY & TO AVOID DAMAGE OR CLEANING CHARGES!! Please also read our delivery/pick up procedure and cancellation policy.

The following Guidelines, policies, terms and conditions apply to the rental of items or provision of services by Coastal Baby Rentals LLC (the “Company,” “we,” “us” or “our”) to you. By submitting your order, you are expressing your agreement with, and consent to, all of these terms and conditions. Please print and save a copy of these guidelines, policies, terms and conditions for your records.

Coastal Baby Rentals takes great pride in offering the best equipment on the market today for your children. Please use the following guidelines to ensure all our products stay in the same condition provided to you:

CRIB CARE:

Our cribs are easy to assemble but please handle with care.  Do not bang crib against walls and paint, scuff marks and knicks in wood are considered damage and will result in additional fees, except for existing normal wear and tear.

No formula drips from bottles to be left on the crib – wipe down if there is milk or formula. When carrying cribs, please take caution not to bang against walls or stairs. Cribs should be carried at all times when moving, carried up and down stairs, never pulled or dragged by just using the top rails or any part of it. Support the bottom of the crib and lightly control the top rail – do NOT put pressure on top rail(s) as it can break if you pull or put too much weight on it.  If the crib is returned broken and with damage, the replacement fee is $350. PLEASE DO NOT THROW AWAY MATTRESS BAG, STORE IT IN A SAFE AREA AWAY FROM YOUNG CHILDREN. We use these for pick up as well to keep the mattress clean during transportation.

CLEANLINESS:  
Products must be returned in the condition received or a fee to be assessed at the time of return will apply to the credit card on file.

Before returning high chairs, please wipe off ALL FOOD from the chair base, straps, seat cover and underneath seat cover. If chairs are returned dirty/with food, a $25 cleaning fee per chair will be charged.

With the exception of high chairs it is highly recommended that no food or leaky bottles be given to children while using the equipment. This includes strollers and joggers – these stain easily if children are given snacks that are not dry goods. If the equipment is stained, a damage/cleaning fee will be applied.

If sun lotion blended with sand is stained into joggers and strollers, we have the right to charge a significant fee since the cleaning is going to be tremendous and in some cases the stain/oil/lotion cannot be removed from the material.

BED RAIL DELUXE GUIDELINES:

Before returning the bed rail, please dissemble the straps and pack all 4 straps – 2 standard and 2 extenders – back in the ziplock bag provided by us along with the manual and place the bag inside the zipped pocket of the side rail. If we don’t receive the straps back in the pocket, you will be responsible for the replacement fee. Another family may be relying on this rail as well, please make certain you include the straps/manual bag inside the zipped pocket.

BEACH GEAR/OUTDOOR EQUIPMENT:

Please watch this video for cabana set up, if you do it wrongly which happens frequently then you’ll be responsible for replacement fees.

Umbrellas and beach cabanas are meant to provide shade from the sun, NOT protection from the wind. If the wind is strong, it can turn the umbrellas inside-out and possibly break the cabana poles.  DO NOT USE ON A WINDY DAY or the replacement fee for a broken umbrella/damaged is $160 and a broken/damaged cabana is $70.
Please include all the parts back in the bag for all umbrellas and cabanas.

Please kindly remove all sand and/or debris from any equipment before return.

LOSS/DAMAGED EQUIPMENT:

Products must be returned with all accessories and parts intact and in proper working order. Any missing pieces, excessive debris or excess damage to rental equipment will be repaired or replaced (depending on the condition) at the expense of the renter. Any additional fees resulting from loss, theft, repair or replacement will apply to the credit card on file. A few of the items replacement costs are listed as below:

CANCELLATION POLICY:
Your payments are charged in full upon your order with our new payment system starting 2018. If refunds are to be made, the current credit card fee of your card will be deducted from the total.

Please note that we work hard to take excellent care of all our customers, and dislike to turn business away when we sell out. If you must cancel, please do so at least 1 week prior to your arrival so we may release your equipment back into inventory. If cancellation occurs within 7 evenings of arrival, a cancellation fee may apply depending on the circumstances, normally 50%. We prefer not to charge you since little kids are involved and anything can happen at the last minute, we are trying to understand and be open minded as much as possible without needing to charge you but please try your utmost to notify us as soon as possible if you need to cancel. If cancellation is within 24 hours of arrival, 100% of your rental fee, minus delivery charges. If the item(s) you rented are no longer needed after we delivered, we are unable to refund you for the item(s) as well.

>7 evenings cancellation: full refund minus credit card payment fee

=<7 evenings cancellation: 50% is refunded minus credit card fee

< 48 hours – no refund: only $30 shipping fee is refunded if entire order is canceled

< 24 hours – no refund: only half of shipping $15 is refunded (50% of shipping for pick up

PAYMENT:
We recommend placing your order at the time you make your vacation reservations but no later than two weeks in advance of the anticipated date of arrival. For orders placed within one week of your arrival date, we encourage you to contact us by telephone to confirm availability. Orders placed within 24 hours of the anticipated delivery date must be made by telephone. Orders are subject to a minimum charge of $50.00. We also charge a delivery fee of $30 per order. We may elect to waive the minimum charge and delivery fee at our sole discretion. We reserve the right to reject any order at our sole discretion.

Full payment of your order (including applicable delivery or other fees) must be made prior to the agreed upon delivery date of your order. Credit cards are verified at the time your order is placed and will be charged prior to order delivery. In some cases, we may accept personal checks or cash payments. Please contact us to make such arrangements. Personal checks must “clear” before your order is delivered. Orders for which full payment has not been received will not be delivered.

Upon submitting your order, you provided a credit card number for payment of your rental. If there is a problem with the credit card, and it is declined, you will need to provide another form of payment as well as an additional $25 fee to cover our own fees and follow up costs.

Coastal Baby Rentals takes great pride in offering our customers equipment in excellent condition – anything not returned as such will need to be taken out of our inventory rotation, so please take care when using it to avoid additional charges. We appreciate your help in keeping our rental equipment clean and in superb condition.

 

SALES TAX

Coastal Baby Rentals charges sales tax for merchandise ordered on this Web site based on the applicable state sales tax rate and the location to which the order is being shipped or delivered.

 

STANDARD DELIVERY INSTRUCTIONS:
Unless otherwise agreed in advanced, the items and services ordered by you from the Company (collectively, the “Rental Items”) will be delivered or provided on the date of your arrival, which in most cases will occur on a Saturday. We typically make deliveries between 10:00PM and 6:00 PM on the scheduled delivery date.

Most Rental Items do not require you to be at the delivery location at the time of delivery. If you are not at the rental location at the time of delivery, your rental equipment will be left for you in a safe place either on the porch or side/back of property; if a hotel then in the lobby with the front desk; if it’s a secured condo unit, please contact us to provide instructions. If we cannot determine a suitable place for dropping the rental equipment (busy street, no porch, high traffic area, non-accessible condo unit) then you will be contacted for further instructions. If you can’t be reached, we regretfully have to cancel your order due to lack of information and instruction. 

Upon delivery, please check the delivery contents to ensure that all of your Rental Items were delivered. Please promptly notify us of any missing, incomplete or damaged Rental Items.  The Renter is responsible for checking each and every Rental Item upon delivery for any damages and must notify Coastal Baby Rentals no later than 10am the next morning after delivery. This includes all beach gear.

PLEASE NOTE: It is your responsibility to provide the correct address and rental dates for equipment delivery.

 

 

 

WHILIE ON VACATION/DURING VISIT

Do not discard any Rental Items. All Rental Items, packaging (bags, coverings, straps) and labels must be returned to the Company upon check out (see “Check Out” below).

You are not required to wash crib linens or towels. However, if you choose to do so, please wash colors separately. For linens, wash using cold water on a delicate cycle with a mild detergent and tumble dry on low heat. DO NOT USE BLEACH.

You are responsible for setting up Rental Items for use. The Company will not set-up equipment, including, without limitation, cribs or other baby-related items. Please follow all instructions for set-up and use of Rental Items. DO NOT DISASSEMBLE OR OTHERWISE ALTER OR MODIFY ANY RENTAL ITEMS.

FOR EQUIPMENT RETURN:

Please remove all sand, sunscreen or other debris from beach-related Rental Items and make sure such items are dry before returning. Please return all baby-related Rental Items in sanitary condition and please remove all stains, food, liquids or other debris from such items before return. You will be charged a cleaning fee with respect to any Rental Items that are not returned in a reasonably clean or sanitary condition.

 

Rental Items must be available for pick-up no later than 9:00 AM on the date of check out and place it back in the safe place outside of your property preferably where the delivery was. If we delivered your Rental Items inside the premises or made a personal delivery, please leave the Rental Items outside the premises in an appropriate place, which, in most cases, will be at an entrance to the premises. Our typical pick up hours are 9am-noon. We are unable to accommodate late check outs in the summer months unless specifically arranged in advance and cannot guarantee availability. If you are leaving ahead of the scheduled pickup date, please inform us 24 hours in advance or you’ll be responsible for leaving items behind without changing the scheduled pickup date if there is a theft. If equipment is returned with damage, a fee will apply to the credit card on file. 

 

DISCLAIMER OF LIABILITY; INDEMNIFICATION

RENTAL ITEMS ARE PROVIDED IN “AS IS” CONDITION. YOU ARE RENTING THE RENTAL ITEMS AT YOUR OWN RISK. PLEASE CAREFULLY READ THE FOLLOWING.

You acknowledge that you are familiar with, and know how to operate, the Rental Items and that you are taking full responsibility for using the Rental Items. You are responsible for correct use of the Rental Items according to manufacturers’ instructions and guidelines. You accept and expressly assume all risks, dangers and hazards that may arise directly or indirectly out of or in connection with the use of the Rental Items, including risk of personal injury, loss of life and property damage. The Company is not responsible for accidents or injuries caused directly or indirectly from the use of the Rental Items.

You hereby, for yourself, your children, any of your other family members, your heirs, next of kin, executors, administrators, personal representatives, agents, successors and assigns and any others claiming through you or under any of the foregoing (the “Renter Parties”), agree to disclaim, waive and release the Company, its members, shareholders, officers, directors, employees, agents, representatives and any other persons or entities affiliated with the Company and, with respect to each of the foregoing, their respective heirs, next of kin, executors, administrators, personal representatives, agents, successors and assigns (the “Company Parties”), from any and all claims, demands, damages, liabilities, costs, actions, causes of action or suits of any kind or nature whatsoever, and particularly on account of any and all injuries, known and unknown, to person or to property or both, which result in any way from the use of the Rental Items. Without limiting the generality of the foregoing, the Company Parties shall not be liable for any personal injury, loss of life and/or other casualty to you, your children, any other Renter Parties or any other adults or children, or any damage to property arising out of or relating to the use of the Rental Items.

You represent and warrant that (i) each of the Rental Items is of a type, design, quality and acceptable to you and suitable for your purposes, (ii) you acknowledge that the Company is not the manufacturer or supplier of the Rental Items or the representative of either; (iii) you acknowledge that the Company is not required to enforce any manufacturer’s warranties on behalf of the Company or you, (iv) you acknowledge that the Company has not inspected and is not obliged to inspect the Rental Items, and (v) that the Company rents the Rental Items “As Is,” without warranty or representation either express or implied, and the Company expressly disclaims any warranty, express or implied, as to (a) the title, condition, fitness for use for a particular purpose, design, compliance with specifications, operation, or merchantability thereof, (b) the absence of latent or other defects, whether or not discernable, or (c) any other matter whatsoever, it being agreed that all such risks, as between the Company and you are to be borne by you.

You agree to indemnify and hold harmless the Company Parties from and against any and all costs or expenses (including attorneys’ fees), judgments, fines, losses, claims, damages, liabilities (including, without limitation, negligence, tort and strict liabilities), and amounts paid in settlement arising, directly or indirectly, from or in connection with the manufacture, selection, rental, purchase, delivery, possession, condition, use, operation, or handling of the Rental Items.

DISCLAIMER OF WARRANTY. ALL RENTAL ITEM(S) ARE RENTED WITHOUT ANY WARRANTY, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

DISCLAIMER OF HEALTH RISK (COVID-19 and others)

DISCLAIMER OF ILLNESS RISK. ALL RENTAL ITEM(S) ARE RENTED WITHOUT ANY WARRANTY TO YOUR HEALTH AS IN ANY ILLNESS RELATE TO BACTERIA AND VIRUS OCCURRING DURING YOUR RENTAL PERIOD, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

 

MISCELLANEOUS

Referrals: When placing an order from one of our recommended businesses, their rates and policies apply. Please make sure to refer to their terms and policies.

Void Where Prohibited: Not all Rental Items are available to all persons or in all geographic locations or jurisdictions. We reserve the right to limit the provision of Rental Items or services to any person, geographic area, or jurisdiction we desire and to limit the quantities of any Rental Items or services we provide. Any offer for any Rental Items or service is void where prohibited.

Entire Agreement; Amendments; Construction: These Terms and Conditions constitute the entire agreement between you and the Company with respect to the Rental Items. These Terms and Conditions supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written between you and the Company. No modification of the Terms and Conditions shall be effective unless it is authorized by the Company in writing. The Company reserves the right to revise these terms and conditions from time to time in its sole discretion. If any provision of the Terms and Conditions is found to be contrary to law, then such provision(s) shall be constructed in a manner to closely reflect, as much as possible, the intentions of the parties, with the other provisions remaining in full force and effect.

Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflicts of laws principles. You and the Company agree to submit to the jurisdiction of any state or federal court sitting in the State of New Jersey, in any action or proceeding arising out of or relating to this Terms and Conditions and the Rental Items and agrees that all claims in respect of the action or proceeding may be heard and determined in any such court. You agree that the venue (i.e., location) for any legal action shall be located within Cape May County, New Jersey.
